Nina Kohn, the David M. Levy Professor of Law and faculty director of online education in the College of Law, was interviewed by Newsweek for the story “Andrew Cuomo’s Nursing Home Shield Means ‘They Got Away with Killing Our Mom.’” Kohn, an expert on elder law and aging, says that government regulators have failed in enforcing proper care procedures and the positive aspect of the liability shield for nursing homes, in turn risking the well being of thousands of elderly people. “This has been an effective way for facility owners and operators to protect themselves from liability — and not just liability for problems caused by COVID-19, but also for serious problems and patterns of behavior that predated the pandemic,” Kohn says.
