“AG slams NY’s legal shield for nursing homes, hospitals”

Nina Kohn, the David M. Levy Professor of Law and faculty director of online education in the College of Law, was quoted in the Associated Press story “AG slams NY’s legal shield for nursing homes, hospitals,” which was also republished in U.S. News & World Report. Kohn, an expert on elder law, says that New York law greatly protect nursing homes, which may encourage poor staffing choices and patient care during the COVID 19 pandemic. “If they’re not going to be held accountable for harm to residents and they’re going to be paid either way, you’ll have a certain percentage of facilities who made the business decision to engage in practices that unreasonably endanger the resident,” says Kohn.
